Terms of Service

1. Acceptance of Terms

By accessing or using GainTrack ("the App"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the App. These terms apply to all users worldwide.

2. Who Can Use GainTrack

You must be at least 18 years old to use GainTrack. By using the App, you represent and warrant that you meet this requirement. If you are using GainTrack on behalf of an organization, you represent that you have authority to bind that organization to these terms.

3. Your Account

GainTrack supports authentication via Google Sign-In or email and password. You are responsible for all activity that occurs under your account. You agree to:

• Maintain the security of your Google account credentials
• Notify us immediately of any unauthorized use of your account
• Provide accurate information in your profile
• Not share your account with others

We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Payments

GainTrack offers a free tier and a Pro subscription ("GainTrack Pro"). Subscriptions are managed through Google Play In-App Billing via RevenueCat.

• Billing: Subscription fees are charged to your Google Play account at confirmation of purchase and at the start of each renewal period
• Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Cancellation: You can cancel at any time via Google Play → Subscriptions. Access continues until the end of the paid period
• Refunds: Refunds are subject to Google Play's refund policy. We do not offer refunds for partial subscription periods
• Price changes: We will notify you at least 30 days before any price change takes effect
• Free tier: Core features remain free. We reserve the right to adjust which features are included in each tier with reasonable notice

5. AI Features

GainTrack Pro includes AI features powered by Google Gemini: AI coaching (chat and progression suggestions), meal-photo analysis, and workout-video form analysis. By using these features, you acknowledge:

• AI responses are for informational and motivational purposes only and do not constitute medical, nutritional, or professional fitness advice
• Always consult a qualified healthcare professional before starting any new exercise or nutrition program, especially if you have existing health conditions
• AI-generated content may occasionally be inaccurate — use your own judgment
• Your messages and any photos or videos you submit for analysis are processed by our backend and Google's Gemini API as described in our Privacy Policy; photos and videos are processed transiently and not retained after your analysis is generated
• You are responsible for the photos and videos you submit, and you should not capture other people without their consent, or record in locations where recording is not permitted
• Daily usage limits apply to Pro users to ensure fair access

6. Health Data

If you enable health integrations (Apple Health or Google Fit), you grant GainTrack permission to read fitness and nutrition data from those sources. You can revoke this permission at any time. GainTrack does not write data to Apple Health or Google Fit without your explicit action. Health data is used only to provide features within the app and is never shared with advertisers.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use automated tools to scrape, crawl, or extract data from the App
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Use the App to harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the App's servers or networks
• Submit false, misleading, or fraudulent content

8. User-Generated Content

GainTrack allows you to create workout logs, nutrition entries, photos and videos (including those you submit to the AI analysis features), and to interact with other users via social features. You retain ownership of the content you create. By submitting content, you grant GainTrack a non-exclusive, worldwide, royalty-free license to store, display, and use that content solely to provide the service to you; photos and videos submitted for AI analysis are used only to generate your analysis and are not retained afterward.

You are solely responsible for the content you submit. Do not submit content that is illegal, harmful, or violates others' rights.

9. Social Features

GainTrack includes friend connections and private leaderboards. You agree to interact respectfully with other users. We reserve the right to remove content and suspend users who engage in abusive, harassing, or inappropriate behavior. Currently GainTrack does not include in-app messaging — all social features are limited to workout statistics sharing and leaderboards.

10. Intellectual Property

GainTrack and all its content, features, and functionality — including but not limited to the software, design, logos, and text — are owned by GainTrack and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

11. Disclaimer of Warranties

GainTrack is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy or completeness of any content in the App, including AI-generated responses, nutritional data, or exercise recommendations.

GainTrack is not a medical application. Nothing in the App constitutes medical advice. Always consult a qualified healthcare professional for medical, nutritional, or fitness guidance.

12. Limitation of Liability

To the fullest extent permitted by law, GainTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, personal injury, or property damage. Our total liability to you for any claims arising from these terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless GainTrack and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these terms, or your violation of any third party's rights.

14. Termination

We may suspend or terminate your access to GainTrack at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account at any time via Profile → Delete Account. Sections of these terms that by their nature should survive termination will survive.

15. Governing Law

These terms are governed by the laws of Greece and the European Union, without regard to conflict of law principles. For EU/EEA residents, mandatory consumer protection laws of your country of residence also apply. Any disputes shall be resolved in the courts of Athens, Greece, except where mandatory local law provides otherwise.

16. Changes to These Terms

We may update these terms as the product evolves. We will notify you of significant changes via the app or email at least 14 days before they take effect. Continued use of GainTrack after changes constitutes acceptance of the updated terms. If you do not agree to the updated terms, you must stop using the App and may delete your account.
